Description of the lecture:
Criminal Justice reform in China has been quite active over the past decade. After amending its Criminal Procedure Law (CPL) in 2012, China launched a series of more radical reform initiatives, such as “trial as the center” reform, leniency for those who pleads guilty and accepts punishment (Chinese style plea bargaining), duty counsel, and compulsory legal representation, etc. An emerging trend of more complicated trial in relatively few cases paralleled with multiple diversion disposals in majority cases can be seen from these exciting reforms.  Meanwhile, China further strengthened human rights protection in criminal cases by reforming its lay participation system and improving the rights protection for those with mental disability. This lecture will provide an overview of all these recent criminal procedure law reforms and argue for a developing trend of China’s criminal justice towards a more effective system with fairer procedure.
